Terms of Service

1.1 Eligibility: You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services.

1.2 Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

1.3 Prohibited Uses: You agree not to use our services for any unlawful purpose or in violation of these Terms.

1.4 Business Use: Our services are intended for business-to-business (B2B) transactions and commercial use.

2.1 Quotations: All quotations are valid for 30 days unless otherwise specified and are subject to acceptance by KREA Makina.

2.2 Order Acceptance: Orders are subject to our acceptance. We reserve the right to refuse any order at our discretion.

2.3 Pricing: Prices are subject to change without notice. Confirmed orders will be honored at the agreed price.

2.4 Payment Terms: Payment terms will be specified in each contract. Late payments may incur interest charges.

2.5 Specifications: Product specifications and technical drawings must be approved in writing before production begins.

3.1 Ownership: All intellectual property rights in our products, services, and website content belong to KREA Makina or our licensors.

3.2 Customer Designs: You retain ownership of your product designs and technical specifications provided to us.

3.3 Confidentiality: We will treat all customer designs and proprietary information as confidential.

3.4 License: By providing designs, you grant us a license to use them solely for manufacturing your products.

4.1 Quality Standards: All products are manufactured according to ISO 9001:2015 and applicable industry standards.

4.2 Inspection: Customers have 7 days from delivery to inspect products and report any defects.

4.3 Warranty: We warrant products against manufacturing defects for a period specified in the sales contract.

4.4 Limitations: Warranty does not cover normal wear and tear, improper use, or modifications made by the customer.

5.1 Delivery Terms: Delivery terms are specified according to Incoterms 2020 (e.g., EXW, FOB, DDP).

5.2 Lead Times: Estimated lead times are provided in good faith but are not guaranteed.

5.3 Delays: We are not liable for delays caused by force majeure or circumstances beyond our control.

5.4 Risk Transfer: Risk transfers to the customer according to the agreed Incoterm.

6.1 Maximum Liability: Our total liability is limited to the value of the specific order in question.

6.2 Indirect Damages: We are not liable for indirect, consequential, or special damages.

6.3 Business Losses: We are not liable for loss of profits, revenue, or business opportunities.

7.1 Applicable Law: These Terms are governed by the laws of the Republic of Turkiye.

7.2 Jurisdiction: Any disputes will be subject to the exclusive jurisdiction of the courts of İzmir, Turkiye.

7.3 Language: The Turkish version of these Terms prevails in case of any discrepancy.

8.1 Amendments: We reserve the right to modify these Terms at any time. Continued use constitutes acceptance.

8.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.

8.3 Entire Agreement: These Terms constitute the entire agreement between you and KREA Makina regarding our services.
